These Terms of Service ("Terms") govern your use of the FIncoming iOS application ("the App") developed by Fincoming LLC ("Developer"). By downloading or using the App, you agree to these Terms.
1. Not Financial Advice
FIncoming is a planning and scenario tool, not a financial advisor. The App's projections, estimates, and outputs are for informational and educational purposes only. Nothing in the App constitutes financial, tax, legal, or investment advice, and nothing in the App should be relied upon as such.
The App uses simplified models and hardcoded assumptions (described in the App's "About" screen). Your actual retirement outcomes will depend on factors the App does not and cannot model. Consult a licensed financial planner, tax professional, or attorney before making financial decisions.
2. Accuracy and Limitations
The App makes reasonable efforts to reflect current tax law, Social Security rules, and IRS regulations as of the date of its last update. However, tax law changes frequently and the App may not reflect the most current rules at the time you use it.
Known simplifications include (but are not limited to): blended state tax rates rather than graduated brackets, a simplified long-term capital gains treatment, and Social Security estimated via bend-point formula rather than your actual SSA earnings record. These are disclosed within the App.
3. License
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices you own or control, subject to the Apple App Store Terms of Service.
You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works of the App.
4. Subscriptions and Purchases
Certain features of the App require a paid upgrade. The following in-app purchase options are available:
- Day Pass — A non-renewing 24-hour access pass. Full paid features are available for 24 hours from the time of purchase.
- Annual — An auto-renewing subscription billed once per year. The subscription automatically renews unless cancelled at least 24 hours before the end of the current period. You can manage or cancel at any time through your Apple ID settings (Settings → [your name] → Subscriptions).
- Lifetime — A one-time non-consumable purchase granting permanent access to all paid features.
Pricing for each option is displayed at the point of purchase within the App and is pulled live from the App Store in your local currency. Prices are never hardcoded in the App. All purchases are processed by Apple and governed by Apple's In-App Purchase terms.
Refunds for in-app purchases are handled by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support directly.
5. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be error-free, uninterrupted, or that any calculations or projections will be accurate or suitable for your situation.
6. Limitation of Liability
To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or savings, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.
In addition, the Developer's total cumulative liability arising out of or relating to these Terms or the App, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the greater of (a) the total amount you paid the Developer for the App in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred United States dollars (US$100).
The foregoing limitations do not apply to liability arising from the Developer's gross negligence, willful misconduct, or fraud, or to any other liability that cannot be limited or excluded under applicable law.
7. Changes to These Terms
The Developer may revise these Terms at any time. Continued use of the App after revised Terms are posted constitutes acceptance of the updated Terms. Material changes will be reflected in an updated "Last updated" date.
8. Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-law provisions.
9. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
10. Entire Agreement
These Terms, together with the Privacy Policy and any other terms expressly incorporated by reference, constitute the entire agreement between you and the Developer regarding your use of the App and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral, regarding the same subject matter.
